This Privacy Policy applies to your use of this website, which includes our email migration service, (collectively, the “Service”) and any additional MigrationWiz client software ("Software"). This Privacy Policy does not apply to any mailbox data you have stored through the Service, including but not limited to emails, calendar and journal entries, notes and tasks.

1. Changes in Privacy Policy

MigrationWiz may change this Privacy Policy at any time. MigrationWiz will provide notice of changes to the Privacy Policy by indicating on this Privacy Policy the date it was last updated and making such updated Privacy Policy available through the Service. Your use of the Service or Software following the posting of the updated Privacy Policy shall constitute your consent to all changes. We encourage you to review this Privacy Policy whenever you access or use the Service or Software to make sure you understand how personal information we collect may be used or disclosed.

2. Collection of personal information

We may collect various types of information about you, including personal, demographic and aggregate data. As used herein, "personal information" means information that specifically identifies you, including but not limited to your name, address, telephone number, email address and credit card information. Demographic information is anonymous information, which may include your age, date of birth, gender, demographic area, hobbies or interests. Demographic information is not considered personal information unless it is linked with your other personal information, which we may do for a variety of reasons such as customizing content according to your interests and preferences. Personal information does not include aggregated or anonymized information, which is data we collect about the use of the Service or Software, from which personal information has been removed. Aggregated or anonymized data is used for a number of purposes such as helping us understand trends and user needs so we can improve our products and services.

Personal information may be collected in a number of ways when you access or use the Service or Software. For example, we may ask you to provide certain personal information when you register for an account, make a purchase, submit feedback, bug reports, or new feature request forms or participate in our online forums or blogs.

When you use the Service or Software, we may also collect certain information about your computer to facilitate and evaluate your use of the Service or Software. For example, we may log environmental variables, such as browser type, operating system, CPU speed, referring or exit web pages and the Internet Protocol (IP) address of your computer. MigrationWiz also uses such information to measure traffic patterns and usage of the Service and Software.

Cookies. In order to improve our Service and provide a more relevant experience to our users, we may collect information using "cookies." • to provide and improve the Service and the Software;
• to send you a welcome email and contact you about your use of the Service or Software (e.g., for administrative and customer service purposes);

• to track customer preferences and inform you about product upgrades, special offers and products and services of MigrationWiz and selected third parties that we think will be of interest to you;
• to respond to your emails, submissions, feedback, bug reports, requests for new features, help requests or other comments, questions or complaints;
• to process and deliver contest entries and rewards;
• to monitor and analyze usage, trends and activities in connection with the Service and Software;
• to automatically determine if you are using the most current version of the Software and to send you email messages, present pop-up boxes on your computer, or utilize similar notification mechanisms to inform you if you need to upgrade in order to use the Service you have requested; and
• to link or combine with other personal information we get from third parties to help understand your needs and provide you with better services.

4. Sharing of personal information

MigrationWiz does not share your personal information with third parties other than as follows:

• when you give us your consent to do so, including if we notify you through the Service that the information you provide will be shared in a particular manner and you provide such information;
• with third party vendors, consultants and service providers who perform functions on our behalf, but we limit their use of the information as is reasonably necessary to carry out their work;
• if you live in a jurisdiction where we have an exclusive arrangement with a third party reseller, we will share your personal information with this reseller in order to provide you with the products and services you requested;
• when we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with laws or respond to lawful requests, legal process or legal authorities;
• when we believe in good faith that doing so is reasonably necessary or appropriate to protect the rights, property or safety of MigrationWiz or our employees, agents, users or others, including to enforce our agreements and policies;
• in extraordinary circumstances, such as to respond to an emergency or for reasons of national security, an urgent matter of public or individual safety or other issues of dire importance;
• in connection with, or during negotiations of, a merger, consolidation, sale of company assets or equity, financing, acquisition, corporate reorganization, strategic alliance or in any other similar situation where personal information may be transferred as one of the business assets of MigrationWiz;
• if you establish an account with MigrationWiz after clicking an affiliation link on a third party website, or if your account registration identifies a MigrationWiz partner who referred you to MigrationWiz, your domain name and the time of your referral will be displayed to that partner for tracking purposes, but MigrationWiz will not share the remainder of your email address or any other personal information (e.g., if JohnDoe@example.com is referred by a MigrationWiz partner at 12 noon on Jan. 1, 2010, the partner could access an administrative page indicating that MigrationWiz received a referral of someone from example.com at that time); and
• if you post information to a MigrationWiz bulletin board, blog or chat room (collectively, "Public Forums"), such information, along with your email address, will be publicly available to all persons accessing that Public Forum. MigrationWiz is not responsible for any information you submit to a Public Forum or the subsequent use of such information by third parties. In addition, you should be aware that the Public Forums offer a service in which subscribers are emailed a copy of all messages posted to such forum on a particular topic. Consequently, if you post a message to a Public Forum, your email address will be sent to those subscribers who have indicated an interest in the topic of your message.

We may also share aggregated or anonymized data that does not directly identify you.

5. Your choices with respect to personal information

MigrationWiz may send information to you regarding products, services and special offers available from MigrationWiz or selected third parties, unless you have opted not to receive such communications or such communications are prohibited by law. If you do not wish to receive such email, regular mail or other messages, you may opt out at the time of registration or information collection by logging in to your account settings and updating your contact preferences. Please note that even if you opt out of receiving email or other communications from MigrationWiz, we may find it necessary to continue to communicate with you regarding your use of the Service or the Software, such as messages related to transactions or services you have specifically requested, in response to any email from you to us, to notify you of updates or changes to our policies and procedures, or to otherwise provide you with information we believe is important to users. Our systems may require time to update, so your opt-out requests may not be updated immediately.

6. Protection of your personal information

MigrationWiz takes reasonable measures to help protect your personal information in an effort to prevent loss, misuse and unauthorized access, disclosure, alteration and destruction.

7. Third party links

The Service may contain links to other websites at which personal information is collected. This Privacy Policy does not apply to linked sites and MigrationWiz is not responsible for the content or privacy and security practices of those sites. Any personal information you provide to a linked site is provided directly to a third party and is subject to such third party's privacy policy. We encourage you to learn more about such third parties' privacy and security practices and policies before providing them with any personal information.
