By making a purchase on the BitTitan website at www.BitTitan.com ("Site") or related services ("Service"), you signify that you have read, understand and agree to be bound by the Terms of Sale in effect at the time of purchase ("Terms of Sale"). Your purchases and your use of the Site and Service are also governed by the BitTitan Terms of Service, which are incorporated herein by reference. As used in these Terms of Sale, the term "purchase" includes conducting a payment transaction with BitTitan to add funds or licenses to your BitTitan account.
These Terms of Sale are subject to change without prior written notice at any time, in BitTitan's sole discretion, and such changes shall apply to any purchases made after such changes are posted to the Site; provided, that IF YOU AGREE TO ANY REVISED TERMS OF SALE IN CONNECTION WITH MAKING A PURCHASE AFTER SUCH A CHANGE, YOU AGREE THAT SUCH REVISED TERMS OF SALE SHALL SUPERSEDE AND REPLACE ANY PRIOR VERSION OF THE TERMS OF SALE TO WHICH YOU MAY HAVE AGREED IN CONNECTION WITH A PRIOR PURCHASE, AND THAT THE REVISED TERMS OF SALE SHALL THEN APPLY TO YOUR PURCHASES MADE PRIOR TO THE EFFECTIVE DATE OF SUCH REVISED TERMS OF SALE. Therefore, you should review these Terms of Sale prior to each purchase so you will understand the terms applicable to such transaction and confirm that you wish to have any revised terms apply to your prior transactions. If you do not agree to these Terms of Sale, do not make any purchases on the Site.
1. Purchase Qualifications; Account Security
To make a purchase on BitTitan, you must have a registered account for the BitTitan Service, comply with these Terms of Sale (including the Terms of Service), and maintain accurate and complete information in your BitTitan user account. You must maintain current billing information at all times, including your billing address, a valid credit card number or other account number, and the expiration date. You acknowledge that, in accordance with the Terms of Service, you are solely responsible for maintaining the security of, and restricting access to, your account, user name and password.
2. Payment Options and Authorization
BitTitan may offer one or more payment options to you, such as one-time payments or recurring automatic payments that occur monthly. For one-time payments, you authorize BitTitan, or its designated payment processor, to charge your specified credit card or payment method in the amount you specify. For recurring automatic payments, you authorize BitTitan, or its designated payment processor, to charge your specified credit card or other payment method for the amount due at the end of the billing period or month. You acknowledge that for recurring automatic payments, the timing and amount of each charge may vary depending on your usage of the Service, and you consent to such variable charges without advance notice to you. You may revoke your authorization for future recurring automatic payments at any time by modifying your payment options in your BitTitan account. Notwithstanding the foregoing, you authorize BitTitan, or its designated payment processor, to charge your specified credit card or other payment method in the amount of any outstanding balance due to BitTitan upon the termination of the Service (as defined in the Terms of Service).
BitTitan may change its prices from time to time for the Service. In the event BitTitan changes the price for a Service, BitTitan will notify you using the email account you provided in your account registration and/or by posting the revised prices on the Site.
3. Payment Terms; Cancellation and Refunds
There are no refunds or cancellations of payments made to BitTitan, including without limitation any prepayments for the Service, except as provided in the Terms of Service or otherwise required by law. BitTitan reserves the right to refuse or cancel any purchases or attempted purchases at any time in its sole discretion.
All charges shall be made in United States dollars or such other currency as indicated during the payment process. Currency exchange settlements are based on your agreement with your credit card or other payment method provider.
You understand that charges for the Service must be paid in advance and that the continued use of these Service requires sufficient funds in your account to pay for each day or use of the Service. If you have an outstanding balance due and do not have a sufficient payment method specified, you will be deemed to have terminated your Service (in accordance with the Terms of Service), and BitTitan may suspend or terminate your Service privileges and remove and irretrievably delete data (as defined in the Terms of Service).
4. Billing Statements; Errors in Charges
BitTitan will provide you with an online billing statement. This is the only billing statement that BitTitan provides free of charge. If you request a paper copy, BitTitan may charge you a retrieval fee. You understand that paper copies are not available covering charges more than 120 days prior to the date of your request. If BitTitan makes an error on your bill, BitTitan will correct it promptly after you notify BitTitan and BitTitan has investigated and verified the error. You must notify BitTitan in writing within 120 days after an error first appears on your bill. If you do not report the error to BitTitan within such 120 day period, BitTitan will not be required to correct the error and you agree to pay the amount billed. You release BitTitan from all liability and claims of loss resulting from any error that you do not report to BitTitan within 120 days after the error first appears on your online statement.
5. Taxes
The price for the Service excludes all taxes, if applicable. You are responsible for any taxes that you are obligated to pay or that BitTitan may collect from you in connection with your purchase. If you do not pay such sales or other tax or fee on a transaction, you will be responsible for such taxes or fees in the event that they are later determined to be payable on such sale, and BitTitan reserves the right to collect such taxes or other fees from you at any time.
6. Privacy
We care about the privacy of our users and customers. Please refer to our Privacy Policy for information on how BitTitan collects, uses and discloses personally identifiable information from its users and customers. By using the Site or the Service, you are consenting to have your personal data (including financial transaction information) transferred to and processed in the United States or any other country in which BitTitan operates.
7. Severability
If any provision of these Terms of sale shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions.
8. Relation to Terms of Service
All of the terms and conditions in the Terms of Service are incorporated herein and apply to these Terms of Sale and your purchases with BitTitan. In the event of a conflict between these Terms of Sale and the Terms of Service, these Terms of Sale shall be controlling.
